Expungement Process

  • In Kentucky, a person who has been charged and found guilty of a criminal offense or whose charges have been dismissed may make a motion to have the charges expunged from his/her record (KRS 431.076 – 431.078)
  • If the charges were dismissed, a motion to expunge should be filed with the court 60 days after the dismissal of your charges
  • If you plead guilty to a misdemeanor, a motion to expunge can be filed five years after your guilty plea
What charges can be expunged?
  • Only misdemeanor offenses may be expunged, with the exception of some felony drug offenses that are potentially eligible for expungement or felonies that were disposed of through the pre-trial diversion program
