Expungement Process

In Kentucky, a person who has been charged and found guilty of a criminal offense or whose charges have been dismissed may make a motion to have the charges expunged from his/her record (KRS 431.076 – 431.078)
If the charges were dismissed, a motion to expunge should be filed with the court 60 days after the dismissal of your charges
If you plead guilty to a misdemeanor, a motion to expunge can be filed five years after your guilty plea

What charges can be expunged?

Only misdemeanor offenses may be expunged, with the exception of some felony drug offenses that are potentially eligible for expungement or felonies that were disposed of through the pre-trial diversion program
